Kasowitz Wins Three-Week Jury Trial for CareOne at Livingston, Defeating Former Employee’s Claims of Retaliation

Kasowitz Benson Torres has won a jury trial on behalf of CareOne at Livingston, a skilled nursing and assisted living facility, following a three-week trial in a case brought by a former employee claiming retaliation under the New Jersey Law Against Discrimination.  The former employee had alleged that CareOne, the employee’s supervisor and the facility’s administrator, retaliated against her by terminating her employment following her complaints of discrimination based on her disability.  At trial, CareOne presented evidence that, among other things, it had terminated the employee for poor performance.
 
The jury in the Essex County, New Jersey Court found that plaintiff had not established that CareOne had engaged in any unlawful retaliation and rejected all of plaintiff’s claims for economic damages, emotional distress damages and punitive damages.
