Kelly Anne Luther and Jacob Abrams Co-Author “Rule 23(b)(3) Predominance in Benefit-of-the-Bargain Actions”
Kasowitz Benson Torres partner Kelly Anne Luther and associate Jacob Abrams have co-authored “Rule 23(b)(3) Predominance in Benefit-of-the-Bargain Actions,” published in the International Association of Defense Counsel’s Product Liability Committee’s January 2020 newsletter. In the article, the authors examine product liability class actions where plaintiffs have alleged that a defect in a product itself constituted, rather than caused, plaintiffs’ injury, and circumstances in which such damages models have been found to satisfy the requirement of “predominance.”
