Kasowitz, on Behalf of Real Estate Firm Xin Capital Times Square, Defeats Motions for Temporary Restraining Order and Preliminary Injunction Seeking to Install Wireless Telecommunication Equipment on Rooftop Easement
On July 23, 2026, Kasowitz LLP, as counsel to real estate investment firm Xin Capital Times Square, LLC, successfully defeated motions for a temporary restraining order and preliminary injunction filed by the telecommunications infrastructure platform and specialized real estate company, Wireless Propco, LLC. Wireless Propco’s motions, filed in the Commercial Division of the New York State Supreme Court, sought an order allowing it to install wireless telecommunications equipment on a terrace pursuant to a pre-existing easement agreement. In denying the motions, Justice Joel Cohen credited Xin Capital’s arguments and permitted Xin Capital to block Wireless Propco’s installation of the equipment.
