Miller have co-authored “Preemption is No Panacea: Congress Must Create a Workable National Framework for American AI Dominance,” published in Corporate Compliance Insights. In the article, the authors discuss how broad artificial intelligence preemption proposals have drawn sharp bipartisan opposition from lawmakers and that the path forward requires congressional action on specific framework components. In addition, the authors discuss bipartisan bills on National Institutes for Standards and Technology (NIST) standards, regulatory sandboxes, and export controls that could advance the AI action plan’s objectives while preserving necessary state regulatory roles.

David A. Miller, Special Counsel at Kasowitz, focuses his practice on matters related to AI, data privacy and security, emerging technologies, and other issues that fall within the jurisdiction of the Senate Commerce and House Energy & Commerce Committees. Prior to joining Kasowitz, Mr. Miller served as Senior Counsel and Policy Advisor for U.S. Senator Kyrsten Sinema, where he handled various legislative and federal policies relating to innovation, science and space. As the primary counsel for the Committee on Commerce, Science and Transportation, Mr. Miller has deep experience working on issues involving AI, data privacy, telecommunications, internet regulation, semiconductors, aviation, commercial space, surface transportation, infrastructure, consumer protection and other related matters.
