Amit R. Vora Authors “The Overlooked Equitable Path to Article III” and “The Third Circuit’s Decision in Sun Valley: An Illumination of Jarkesy’s Article III Implications”

Kasowitz partner Amit R. Vora has authored two articles on constitutional separation-of-powers issues relevant to companies and individuals facing federal regulatory pressure.
In “The Overlooked Equitable Path to Article III,” published in the Yale Journal on Regulation, Mr. Vora explains that regulatory targets may protect their private rights under Article III by framing government proceedings as cases in equity – a point that courts and litigants alike have missed.
In “The Third Circuit’s Decision in Sun Valley: An Illumination of Jarkesy’s Article III Implications,” published by the Washington Legal Foundation, Mr. Vora discusses bedrock separation-of-powers principles and uses Sun Valley to show that regulatory targets may rely on Jarkesy to challenge government proceedings on Article III grounds, not only Seventh Amendment grounds.
