Kasowitz Secures Dismissal of Lawsuit against Developer of the American Dream Mall

Kasowitz, on behalf of the developer of the American Dream mall and its affiliates (the “American Dream Defendants”), has secured the dismissal of state litigation brought by the project’s successor junior mezzanine lender, SOL-MM III, LLC., in the Supreme Court of the State of New York, New York County.  The lender was pursuing a $400 million claim against the American Dream Defendants arising out of a restructuring of the project’s financing in 2021 and 2022.  On April 15, 2025, after granting a motion by the project’s senior lender, JPMorgan Chase Bank, N.A., to intervene, the Supreme Court of the State of New York, New York County, heard oral argument on the junior mezzanine lender’s petition for turnover under Article 52 of the New York Civil Practice Law and Rules and the American Dream Defendants’ motion to dismiss the petition and reserved decision on both.  On October 14, 2025, our client’s motion to dismiss was granted and the junior mezzanine lender’s petition was denied.
