Marcus A. Barber Named One of California’s Top 40 Lawyers Under 40 by the Daily Journal

The Daily Journal has recognized Kasowitz Benson Torres partner Marcus A. Barber on its 2020 Top 40 Under 40 list.  The annual listing recognizes California’s most promising lawyers under age 40 who have had significant achievements over the past two years.  

Mr. Barber’s practice focuses on complex patent infringement litigation involving a wide range of technologies.  Mr. Barber is a key member of the Kasowitz team representing MV3 Partners in an action against Roku involving a patent covering the use of a media player that can receive both a television signal and mobile phone streaming content.  In October 2019, the team prevailed in an important claim construction hearing when Judge Alan Albright in the Western District of Texas upheld MV3’s construction of the claims at issue.  Trial is scheduled for Fall 2020.

Mr. Barber is also a key member of the Kasowitz team representing Fintiv in a case against Apple involving a patent covering the management of virtual cards stored on mobile devices.  In May 2020, Kasowitz prevailed before the Patent Trial and Appeal Board which denied Apple’s inter partes review petition.  In March 2020, in another important victory in which Mr. Barber played a major role, the team also defeated Apple’s request for rehearing by the entire Federal Circuit Court of Appeals of a three-judge panel’s decision denying Apple’s motion to transfer the case from Texas to California in March 2020.  Trial is scheduled in the Western District of Texas for 2021.
