The U.S. Court of Appeals for the Second Circuit, on April 3, 2012, reinstated Kasowitz client Anderson News' antitrust case against major media companies. The Second Circuit, in reversing the district court’s dismissal of the action, found that Anderson News, a magazine wholesaler now in bankruptcy proceedings, has alleged a plausible antitrust conspiracy to drive the company out of business. The defendant magazine publishers and distributors include American Media Inc., Bauer Publishing, Curtis Circulation Company, Distribution Services, Hachette Filipacchi, Hudson News Distributors, Kable News Distributors, Rodale Publishing, Time Inc. and Time Warner Retail. Kasowitz partners Marc E. Kasowitz, Daniel R. Benson, Hector Torres and Maria Gorecki are leading Anderson’s representation in federal district court.
