KBT&F Obtains Acquittal of Former McKessonHBOC General Counsel Jay Lapine

On November 19, 2009, following a second jury trial and ten years of investigation and litigation, KBT&F partners Marcus S. Topel and Lyn Agre obtained not guilty verdicts for former McKessonHBOC General Counsel Jay Lapine.  Lapine is perhaps the most prominent corporate general counsel to be indicted as a result of the financial fraud investigations conducted over the past ten years.  The San Francisco Federal jury found Mr. Lapine not guilty of all three charges he faced: securities fraud, falsifying books and records of the company, and circumventing internal company controls. Separately, the jury rendered a guilty verdict as to Mr. Lapine's co-defendant, former HBOC CEO (and former Chairman of the Board of McKessonHBOC) Charles McCall (not represneted by KBT&F).  Mr. Topel and Ms. Agre were assisted in the Lapine representation by partners William M.
