Ninth Circuit Affirms the Grant of Summary Judgment to KBT&F Client Hoechst Celanese Corporation

On March 5, 2009, the Ninth Circuit affirmed summary judgment in favor of KBT&F client Hoechst Celanese Corporation ("Celanese"), a leading chemical manufacturer, in a case arising from the plaintiffs' alleged personal injury and property remediation damages from exposure to toxic mold allegedly caused by leaking plumbing purportedly containing fittings made from a raw material supplied by Celanese. The district court had granted Celanese's summary judgment motion in its entirety, on the ground (among others) that there was no evidence that Celanese's raw material caused any of the plaintiffs' alleged injuries.
