The U.S. Court of Appeals for the Ninth Circuit, on February 27, 2012, affirmed a preliminary injunction granted in favor of Kasowitz client Verizon Wireless. In the underlying lawsuit, Verizon Wireless alleged that the defendants had fraudulently obtained access to Verizon Wireless’s network in order to market their premium text messaging services to Verizon Wireless’s customers through unauthorized and deceptive websites. The trial court determined that Verizon Wireless was likely to succeed on its claims, and therefore granted Verizon Wireless’s request for a preliminary injunction, preventing defendants from continuing such marketing. On defendants’ interlocutory appeal, the Ninth Circuit, just ten days after oral argument, affirmed the trial court, finding in favor of Verizon Wireless on all issues, and upheld the trial court’s preliminary injunction.
