Texas Court Dismisses Mesothelioma Claims Against Kasowitz Client
On April 4, 2008, Kasowitz obtained summary judgment dismissing mesothelioma claims filed by an individual against a client in an action pending in Harris County, Texas. Plaintiff James O'Neill had a confirmed diagnosis of malignant mesothelioma and had worked as an independent contractor pipefitter at the defendant's facilities in the late 1960s and early 1970s. Kasowitz obtained summary judgment in the case under Chapter 95 of Texas' Civil Practice and Remedies Code based on the defendant's lack of control over the manner, method and operative detail of O'Neill's work.
