Kasowitz Client Cushman & Wakefield Wins Complete Dismissal in $80 Million Superstorm Sandy Litigation

On October 30th, 2015, a New York Commercial Division judge dismissed with prejudice the remaining claim against Kasowitz client Cushman & Wakefield (“Cushman”) brought by Orient Overseas Associates (“Orient”).  Orient accused Cushman, a global commercial real estate services company, of breaching its Management Agreement and negligently misrepresenting to Orient the terms of flood coverage that it had procured on behalf of Orient.  The Court dismissed these claims in a detailed 15-page decision , holding that the documentary evidence submitted by Cushman, in addition to admissions Orient made in opposing to Cushman’s motion, “utterly dooms Orient’s claim against Cushman.”
