Elisheva Hirshman represents employers and senior executives in all aspects of employment-related litigation before federal and state courts, administrative agencies and arbitration panels.  Her litigation experience includes defense of claims of sex, race, national origin and age discrimination and sexual harassment, as well as claims brought pursuant to the Family and Medical Leave Act, disputes involving the enforcement of employment contracts and non-competition covenants, tort claims arising out of the employment relationship such as fraud, breach of fiduciary duty, tortious interference and defamation, and pursuing claims under the Employee Retirement Income Security Act.  Elisheva also advises clients on a broad variety of subjects including: terminations and other disciplinary actions; employment, consulting and separation agreements; investigations of alleged harassment and other employee misconduct; employment policies and practices; and litigation avoidance.

Elisheva is a member of the Federal Bar Council and its Inn of Court, as well as the Dartmouth Lawyer’s Association and the New York Bar Association.

  • Representation of one of the nation's leading diversified natural gas companies in employment-related matters, including defense of a national origin discrimination and retaliation lawsuit and an FMLA retaliation and whistleblower lawsuit, in which the firm’s client obtained a denial of the plaintiff’s Petition for a Writ of Certiorari to the United States Supreme Court.
  • Representation of an international restaurant group in connection with threatened employment litigation, including alleged discrimination and retaliation claims.
  • Representation of a major global apparel maker and retailer in employment-related matters, including defense of a race, gender and age discrimination lawsuit.
  • Representation of a leading investment management firm and its affiliate, including a dismissal on summary judgment of a longstanding compensation dispute brought in New York by the affiliate’s former Chief Executive Officer who sought an ongoing interest in the affiliate’s net profits following his termination of employment and an equity stake in the affiliate based on alleged oral agreements and various tort and quasi-contract theories.
