Darcy L. Jones is a member of Kasowitz’s intellectual property group, where she practices in the areas of patent and trade secret litigation.  Her practice covers a wide range of technologies, including pharmaceuticals, specialty chemicals, luxury consumer products, and computer software.

Darcy has considerable experience representing clients in diverse and complex matters in all phases of litigation in state and federal courts, from pre-filing investigation through post-trial briefing and appeal, and case management.  She also has extensive experience in both written and oral advocacy, arguing numerous discovery and dispositive motions, examining witnesses, taking and defending expert depositions, and drafting trial and appeal briefs.  Darcy has tried three patent cases to judgment in the past five years.

Darcy is recognized in the 2015 edition of The Legal 500 and as a "Rising Star" in the 2014 edition of Georgia Super Lawyers.

Notable Representations

  • Jang v. Boston Scientific Corp. et. al., successfully secured a jury trial verdict in favor of Dr. G. David Jang against medical device manufacturer Boston Scientific Corporation for infringing Dr. Jang's patent on a stent he invented for treatment of certain atherosclerotic lesions and for breaching its contractual obligations to pay him royalties on its sales of the stent.
  • Suomen Colorize Oy v. Verizon (D. Del), defending certain Verizon entities regarding patent infringement allegations relating to their interactive media guide technology.
  • Valeant International (Barbados) SRL v. Watson Pharmaceuticals Inc. et al. (S.D. Fla.), represented Watson through trial of a Hatch-Waxman case relating to Aplenzin®.
  • Takeda Pharmaceuticals et al. v. Teva Pharmaceuticals (D. Del.), represented one of the world’s largest pharmaceutical companies (Teva) through two trials of Hatch-Waxman cases relating to Prevacid® products.
  • United Promotions, Inc. v. Lindsay Corp. et al. (Miami-Dade County, Fla.), represented UPI, a specialty chemical company, in trade secret litigation and arbitration involving quaternary ammonium products.
  • Teva Pharmaceutical Industries Ltd. v. AstraZeneca Pharmaceuticals LP et al. (E.D. Pa.), represented one of the world’s largest pharmaceutical companies (Teva) through summary judgment in a case involving Crestor®.
  • Bains Ultra Inc. et al. v. 7677 East Berry Avenue Associates, L.P. et al. (D. Colo.), represented Bains Ultra in litigation involving trademark counterfeiting and patent and copyright infringement relating to jetted bathtub products.
