Biography:
Kanchana Leung’s practice focuses on complex civil litigation, including multidistrict litigation and class actions. Kanchana has successfully represented clients in a broad range of disputes, including commercial contracts, securities fraud, RICO, civil conspiracy, antitrust, and Constitutional litigation. She has extensive experience litigating cases involving structured financial products and derivatives, including credit default swaps, credit-linked notes, auction rate securities, and foreign exchange swaps. In addition, Kanchana is well-versed in electronic discovery issues and advising clients on how to avoid the pitfalls of the discovery process.
Notable Representations Kanchana’s current or recent engagements have included representing:
- a hedge fund invested in credit-linked notes in seeking to recover monies misappropriated from a trust holding its cash collateral;
- an investment fund in seeking to recover a cash settlement payment in a fixed recovery credit default swap;
- businesses whose operating cash was invested in now-illiquid auction rate securities in actions against banks, broker-dealers, and investment advisors;
- an insurance holding company in a New Jersey RICO action asserting claims against a group of short-selling hedge funds and securities analysts;
- an insurance company in defending against policyholders’ efforts to unwind and annul the transformation of its business;
- a foreign bank in successfully defeating class certification in a case involving allegations of conspiracy and aiding and abetting fraud; and
- a trade association for firearms manufacturers in litigation involving the Second Amendment.
